Categories/Origin of data 

In the context of the application process, we collect and process the following personal data:

  • Your master data (surname, first name, name affixes, date of birth, any applicable title)
  • Information on skills and training completed (e.g. CV, certificates)
  • Contact information (address, telephone number, email address)
  • Work permit/residence permit, if applicable
  • Criminal record / certificate of good conduct, as applicable
  • Language skills, as applicable 
  • Driving licence, if applicable
  • Additional (voluntary) information such as the earliest possible start date, regional mobility or desired number of hours and length of contract, previous employment at s.Oliver.
  • Information on how to become aware of the vacancy
  • Where appropriate, optional information regarding community involvement
  • There is also the option of uploading various categories of data or application-relevant information to our portal via your respective social network profiles.

 

Your personal data will be collected directly from you as part of the application process. Exceptionally, your personal data may also be collected from other bodies in some cases, e.g. recruitment agencies or “headhunters”.

In addition, we use personal information collected in a permissible manner from publicly available directories (e.g. professional networks). For example, we contact candidates via the corresponding features of professional portals, where their professional profiles look like a good fit to us. We then ask these candidates to apply to us through our portal.

 

Purposes and legal bases of data processing

During the collection and processing of your personal data, the regulations of the EU GDPR, the Federal Data Protection Act (new) and all further regulations under employment law are always complied with.

According to Section 88 Par. 1 EU GDPR in conjunction with 26 Par. 1 Federal Data Protection Act (new) personal data of employees may be processed for the purposes of employment, if this serves the purpose of deciding whether to establish an employment relationship or to carry out or terminate the employment relationship. 

In addition, permission for data processing, including special categories of personal data, may arise from certain other legislation, in particular due to industry-specific (compliance) requirements.

Of course, a data protection law permission regulation can also represent your consent to data processing. Here we inform you about the purpose of data processing and about your right of revocation according to section 7 paragraph 3 of the EU GDPR and section 88 paragraph 1 EU GDPR in connection with. 26 Par. 2 Federal Data Protection Act (new). When the consent also refers to the processing of special categories of personal data, we will expressly draw your attention to Section 88 Par. 1 EU GDPR in conjunction with the consent. 26 Par. 3 Federal Data Protection Act (new).

Processing of special categories of personal data within the meaning of Section 9 paragraph 1 EU GDPR will only take place when this is required by legal regulations and there is no reason to assume that your legitimate interest in the exclusion of the processing prevails, Section 88 paragraph 1 EU GDPR in conjunction with. 26 Par. 3 Federal Data Protection Act (new).

For the purposes of identifying applications, certain basic information on the candidates is stored on our systems for a period of 365 days (in the case of trainees: for a period of 180 days). This information comprises the full name, date of birth and email address as well as the (internal) candidate number.

 

Registration / user account (Section 6(1a) and (1b) EU GDPR)

On our website, we offer users the option of registering by providing personal data (user account).

In this case, the principle of data economy and data reduction is observed, as only that data which is necessary for registration is marked as a mandatory field with an asterisk (*). This includes, for example, an email address and password, including password repetition.

By registering on our website, the IP address of the user and the date and the time of the registration is stored (technical background data). By clicking the "Register Now" button, you consent to the processing of your data.

Please note: The password assigned by you will be stored in encrypted form. Employees of our company are not able to read this password.

Of course, you can also cancel or delete your registration and/or customer account (if applicable, describe how this can be done).

Our portal offers the option of setting up a job alert, based on the search criteria. The current vacancies will then be sent via email or RSS feed.

 

Security of data transfer

We use appropriate technical and organisational security measures to protect the data stored by us against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. The security levels are checked continuously in cooperation with security experts and adapted to new security standards.

The security of your data is of course a matter of concern for us, including during any transfer within the s.Oliver Group or to our partners/third parties – correspondingly, secure transmission methods are chosen:

The transfer of data generally occurs via transport-encrypted connections. Here we use state-of-the-art protocols, such as TLS 1.2 with PFS.

Data exchanges to and from our website are therefore entirely encrypted. The transmission protocol we offer for our website is HTTPS, using the latest encryption protocols.

In our company, we ensure that only those departments and individuals receive your application data as required by them in order to implement the application process. In the case of unsolicited applications sent to us via the application tool, it is possible for your application to be forwarded within the Group, so that a check can be made as to whether your application matches any current vacancies.

Please note that in the case of simultaneous or multiple (direct) applications for various companies within the Group, each HR or specialist department will be made aware of the relevant applications and their status.

Our portal offers the option of sharing job vacancies.  This can be done via email or social media. By way of clarification: s.Oliver does not forward any personal data via these channels to third parties. Service providers are not used in the process of the selection of candidates; each application will be processed exclusively within the s.Oliver Group.

 

Storage duration of the data

We will delete your data as soon as it is no longer required for the above-mentioned purposes. For application documents, this occurs after six months. For six months after the completion of the application process, application data is stored for statistical purposes in anonymous form.

Further storage for the purpose of filling future vacancies via our Talentpool, which had not been published at the time of application, occurs only if you have given us your express consent.

Data will only be retained beyond this in cases in which we are obliged or entitled to do so, e.g. if you have given us permission to store your data for a certain, longer period, or in exercising a right.

Regulations that oblige us to store it can be found, e.g., in the German Commercial Code or the Tax Code. This can result in a retention period of up to ten years. In addition, the statutory limitation periods must be observed.

Please note in connection with your user account (this is made up of the full name and the email address): The access data for the respective application account will be deleted after six months. 

Renewal is only possible if you send us appropriate consent: this then extends the life of your account for a further six months. If, at the end of his/her retention period, a given user has an ongoing application, the retention period shall be extended until the end of this application.

 

Rights of the persons affected

 The rights for you as an affected person are standardised in Sections 15 - 22 EU GDPR.

These include:

  • The right to information (Section 15 EU GDPR)
  • The right to correction (Section 16 EU GDPR)
  • The right to deletion (Section 17 EU GDPR)
  • The right to restriction of the processing (Section 18 EU GDPR)
  • The right to object to the processing (Section 21 EU GDPR)
  • The right to data transferability (Section 20 EU-DSGVO)

When we process your data to protect legitimate interests, you can object to such processing at any time for reasons arising from your particular situation; this also applies to profiling that is based on these provisions. 

We will then no longer process your personal data, unless we can prove compelling reasons worthy of protection for the processing that outweigh your interests, rights and liberties, or when the processing serves to assert, exercise or defend legal claims.

When we process your personal data for the purpose of direct marketing, you have the right to object without giving reasons; this also applies to profiling, insofar as it is connected with such direct marketing.
